According to Miller v. California (1973), the Supreme Court does not recognize obscenity as having any First Amendment protection. So, if the Court affords no First Amendment protection to obscenity, what topical cases are there in this area? Cases like Hudnut afford protection to pornography not obscenity. I'm not sure overruling cases where pornograph was given protection are topical, given how the resolution is worded.
